Privacy Policy

Foreword:

In the context of data privacy, a data subject is any natural person, whose date is processed.

As you read this, you probably will be a data subject whose data is processed by us soon. Hence, below we say “you” instead of “data subject” to simplify the text.

1 Collection of personal data

We process your data ...

  1. To get/keep in touch with you

    1. along existing contracts or customer relationships with you,

    2. when you evinced interest in our products or services, or

    3. to deal with your queries (e.g. when you sent us an email or use our online contact form)..

  2. As far as our products or services address certain clients only (e.g. companies): To check whether you meet these criteria prior to entering into a contract.

  3. To perform contracts with you; this includes the order management, shipping goods on order, invoicing and book keeping.

  4. For customer relationship manag ement; this includes after-sales-services

  5. To fulfil our legal obligations

  6. For the establishment, exercise or defence of legal claims.

 

Our data processing is lawful because it is done on the following legal basis:

  1. It is necessary to perform a contract with you or someone represented by you (e.g. your employer).

  2. It is necessary in order to take steps at your request prior to entering into a contract.

  3. It is necessary for compliance with a legal obligation to which we are subject.

  4. It is necessary for the purposes of the legitimate interests pursued by us or by a third party (e.g. you or your employer, if you act on his behalf).

1.c Legitimate interests pursued by us or by a third party

  1. You want adequate replies on your queries.

  2. You want a smooth performance of your orders.

  3. You and we are both interested on a good contract and customer relationship. This includes that we contact you e.g. to inform you about a new service, a new product or a new version or function of an existing product, as far as we act on the assumption that this information is also in your interest.

  4. As far as our products and services address certain clients only or as far as our offers are subject to certain conditions, we want to be able to check that these criteria are met.

  5. We want to be able to establish, exercise or defence legal claims without restrictions.

1.d Categories of recipients of the personal data

Your data may be passed on to the following recipients:

  1. Mail service and internet providers, intermediary service providers

  2. Distribution partners

  3. Providers to support us with payment transactions

  4. Providers to support us in book keeping and fiscal things (e.g. tax accountant)

  5. Collection agencies

  6. IT providers

1.e Transfer personal data to a third country or international organisation

A transfer of personal data to a third country or international organisation is not intended.

2 Further information necessary to ensure fair and transparent processing

2.a Criteria used to determine the period for which the personal data will be stored

The data will be stored, as far as it is necessary to fulfil the purposes (see 1.c) and for the purposes of the legitimate interests (see 1.d). This means:

  1. Under the terms of the law (e.g. during retention periods for fiscal relevant data).

  2. While contract and customer relations persist.

  3. As far as it is necessary to establish, exercise or defence legal claims (e.g. during periods of limitation)

  4. As far as it seems to be necessary for keeping up ongoing or future communication with you.

2.b Existence of the right to request from the controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability

  1. You have the right to obtain access to the personal data processed by us.

  2. You have the right for rectification, erasure and restriction of processing of your personal data processed by us.

  3. You have the right to object to processing of personal data concerning you.

  4. You have the right to withdraw consent at any time. This does not affect the lawfulness of processing based on consent before its withdrawal.

To exercise your rights, contact the controller (see 1.a).

2.c Right to lodge a complaint

If you think, that the processing of your data by us violates data privacy regulations, you have the right to lodge a complaint with a supervisory authority.

The supervisory directly responsible for us is:

2.d Requirement to provide personal data

Where personal data is required, the input fields in forms are marked obligatory or we ask explicitly for these data.

Besides that we do not want your personal data. We are not liable for unrequested personal data sent to us.

Below you find an overview of the personal data which is required usually.

2.d.I Queries

  1. In case you act on behalf of a company:
    To answer your queries, you have to provide the company name and a compane email address. No personal data required.

  2. In case you do not act on behalf of a company:
    To answer your queries, you have to provide at least your name and email address. Depending on your query, further personal data might be required such as your address or phone number.

We reserve the right to ignore queries which are anonymous, where sender data is inconsistent or where we doubt the correctness of that data.

2.d.II Entering or performing a contract, post-contractual activities

For entering a contract, to perform a contract and for post-contractual activities, further personal data might be necessary, e.g. a mail address for shipping or invoicing.

2.e Automated decision-making and profiling

We neither use automated decision-making nor profiling.
